Steve Nash Wins Appeal Against BC Fitness Chain In Lawsuit

It’s been a long, arduous battle for Steve Nash, but the NBA Superstar won his appeal this week against SNFW Fitness B.C. Ltd.

The NBA superstar wanted the fitness chain to stop using his name and/or image in partnership with their 21 fitness facilities around British Columbia; however, the court sided with the defendant in August 2017.

Back then, the court determined that there was no issue for the case to be brought to trial. The court found that according to a 2006 agreement, Nash’s company, B & L Holding, authorized the use of his name until 2022.

Nash had acknowledged these conditions when he signed the document. Therefore, the Judge did not find SNFW Fitness B.C. Ltd to be in breach of contract.

Subsequently, Nash appealed that ruling, and won in court on Wednesday, June 6th.

A three judge panel determined that the underlying issue, “is whether under California law a business can continue to use the endorsement of a celebrity when the celebrity is no longer using the business’ product.”

Further, the ruling concedes that the defendants properly obtained the endorsement to use the name; however, “they failed to provide a complete answer to the allegation that continued use of the endorsement contravened California law.”

Nash is originally from Victoria, British Columbia. He is also the only Canadian to ever be awarded the Most Valuable Player Award in the NBA.
