You Can Claim Up To $300,000 From A Beverage Class-Action Settlement

You could be eligible to claim a huge chunk of an approved class-action settlement if you’ve consumed certain recalled milk products.

The lawsuit was filed against Danone Canada, a subsidiary of Danone SA, after a listeria outbreak lead to a number of deaths, as well as hospitalizations.

Silk Beverage Listeria Outbreak

In 2024, a listeria outbreak was traced back to a line of planet-based refrigerated beverages. They were sold under the Silk and Great Value brands. These drinks were believed to be the outbreak’s source, with some affected flavours potentially including cashew, oat, coconut, and almond.

According to Health Canada, listeria is a type of bacteria that can cause an illness called listeriosis. If you consume food or beverages that are contaminated with listeria, you can become infected and develop listeriosis.

Reportedly, there were three deaths, 15 hospitalizations, and 20 illnesses associated with the affected products.

The settlement was approved in the Superior Court of Quebec in April.

Submitting a Claim

Eligible Canadians can submit a claim form before the deadline. The settlement applies to the following class members:

All persons in Canada who purchased or ingested the Silk Canada Products or Great Value Products subject to the Recall initiated by Danone Canada on July 8, 2024, including those who have suffered any Personal Injury as a result thereof, and their successors, assigns, family members, and dependants (the “Class”).

“Personal Injury” refers to any physical and/or psychological harm, as per the claims website.

How much you can receive from the settlement depends on a few factors, with a total of six levels of compensation available. Most cases will result in a payout range of $400 to $7,000. Although, for those who consumed the recalled product and contracted an illness or symptoms that otherwise resulted in death, their estates or beneficiaries may be entitled up to $300,000.

The claim period ends on October 16, 2026.
